Business Dispute Unfolds in Harare Court

In a courtroom drama, a Harare businessman found himself under scrutiny as he accused his former colleague, Ronald Nyandoro, of theft of trust property. The businessman, James Landon, claimed that he bestowed a token of appreciation—a Toyota Landcruiser vehicle—to Nyandoro for aiding him in consultancy work.

According to Landon, Nyandoro allegedly failed to return the vehicle, along with its registration book, as per their agreement. However, Nyandoro, represented by legal practitioner Admire Rubaya, refuted these claims. He argued that there was no trust agreement, stating that Landon gave him the vehicle as payment for consultancy services rendered during a dispute with another businessman, Adam Woodington.

Nyandoro asserted that he became the rightful owner of the vehicle in November 2022, in exchange for his consultancy fees. He also claimed that Landon provided him with the duplicate registration book in 2023.

During cross-examination, Landon admitted to not compensating Nyandoro for his assistance during business transactions in South Africa, claiming it was a gesture of friendship. Rubaya highlighted Nyandoro’s involvement in signing agreements on Landon’s behalf during his absence, indicating a business relationship beyond friendship.

Rubaya argued that Landon’s accusations were baseless and motivated by animosity, emphasizing that there was no evidence suggesting the vehicle was loaned to Nyandoro. Despite their previous association, Landon confirmed that he no longer considered Nyandoro a friend.

“The Accused person further asserts that these are clearly malicious, frivolous and vexatious allegations being peddled by the complainant who is abusing the criminal justice system in relation to a matter whose alleged facts do not disclose an offence recognised at law,” Rubaya told court.

The lawyer insinuated that Landon’s accusation of theft arose only after their relationship soured, refuting any claims of a trust agreement. He maintained that Nyandoro and Landon were merely business associates, and any services rendered should be duly compensated.
