A Harare magistrate has raised concerns about jurisdiction in the Yagden Engineering Pvt Ltd case, involving directors Wayne Williams and Regis Maburutse, who face allegations stemming from Chiredzi, but may be tried in Harare.
The two directors are charged with theft of 35 unassembled motorcycles. The accusation comes from Tony Renato Sarpo, a former director of the company who initially denied ownership of the motor bikes but later contradicted himself.
Addressing the State, represented by Rufaro Chonzi, Magistrate Dennis Mangosi, who has been routinely remanding the case since March this year, admitted that he had previously failed to carefully review the Form 242. After closer examination, he realized that the allegations are centered around Chiredzi.

Magistrate Mangosi questioned the prosecution’s decision to hear the case in Harare rather than Chiredzi. Chonzi responded that they would investigate the matter.
The matter was rolled over to 17 October.

Williams, Maburutse, and Sarpo have been embroiled in legal proceedings since 2016, with numerous allegations centered around Chiredzi.
This is the first time that jurisdiction has been questioned in the Yagden Engineering saga, despite some of them having already been heard in a Harare court instead of in Chiredzi.
