Man Demands US$45K in Damages After Wife’s Infidelity

A man is seeking US$45,000 in damages from his wife’s alleged lover.

Vincent Chiwawa has taken legal action against Alfos Bukhosibethu Nyathi, an employee of the Environment Management Agency (EMA) based in Plumtree, demanding compensation.

His wife, Christian Kagande, admitted last year to being unfaithful while Vincent was in the process of arranging her relocation to the United Kingdom.

The couple had been married since 2010.

Vincent uncovered the extramarital affair, which reportedly took place between 2020 and 2024.

On January 8, Chiwawa applied for a default judgment after Nyathi failed to respond to the legal summons. The court granted his request.

In his claim, Vincent is demanding US$45,000 as compensation for humiliation and loss of companionship resulting from the affair.

He stated that their marriage, formalized under the Marriage Act (Chapter 5:11), was officiated in Plumtree on March 26, 2021, and remains legally binding.

The couple has two children, aged 14 and 11.

Vincent moved to the UK on December 16, 2023, in pursuit of better opportunities and had planned to bring his family over once he was settled.

However, on November 18, 2024, his wife admitted to having an affair with Nyathi.

Kagande detailed how she had been intimately involved with Nyathi, both before and after her husband’s relocation, without using protection. She first confessed to her pastor, who advised her to be honest with her husband.

A close friend of the couple verified the confessions, while their children also corroborated the claims. The children had informed their father that their mother frequently left home at night under the pretense of attending church meetings but was actually meeting her lover.

The situation affected the children academically, causing their school performance to decline as they faced ridicule from neighbors due to widespread gossip about the affair.

Being a small town, Plumtree residents soon learned about the infidelity, making it a popular topic of discussion.

Vincent asserts that the scandal tarnished his reputation, leading to a loss of respect among his peers and professional associates.

He further stated that media coverage, particularly in H-Metro, amplified his humiliation.

According to legal documents, Vincent argues that Nyathi’s prolonged involvement with his wife shattered his marriage and deprived him of the family life he had worked hard to build.

Additionally, he claims that due to the affair, his wife no longer finds him attractive or responds to his affection in the same way, affecting their intimacy.
