Justice Pisirayi Kwenda of the High Court is set to receive an update on Friday concerning the State’s investigation into Marry Mubaiwa’s request for a permanent stay of her trial.
Mubaiwa, who is the former wife of Vice President Constantino Chiwenga, sought to have her prosecution permanently halted last year, citing her deteriorating health.
Her attorney, Beatrice Mtetwa, informed the press in Harare on Wednesday that although the hearing was initially scheduled for that day, it was postponed because the State had failed to upload the necessary documents as agreed.
The judge emphasized that the results of the ongoing investigation would play a crucial role in deciding whether to grant the application for a permanent stay. According to Mtetwa (as reported by NewZimbabwe.com):
“There was a case management today… the judge indicated that further investigations were needed before deciding on whether our application for a permanent stay could be successful.”

Mtetwa explained that when the case last appeared in court, it was agreed that the investigation would continue. The corresponding documents were exchanged and submitted to the prosecution department on December 12. However, for reasons unknown, the documents were not uploaded or forwarded to the judge as planned.

The case will return to court on Friday, January 19, for an update on the progress of the investigation.
Mubaiwa has been struggling with severe health issues for over five years, which have prevented her from standing trial or communicating with her legal team. She suffers from lymphoedema, a condition that has led to the loss of both of her limbs, leaving her confined to a wheelchair.
The former model faces serious charges, including attempting to murder Chiwenga while he was hospitalized in South Africa, as well as accusations of money laundering. However, her trial has been repeatedly delayed due to her ongoing health problems.
