The Commercial Division of Zimbabwe’s High Court in Harare has issued a ruling allowing the sale of Prophet Walter Magaya’s hotel and stadium to satisfy a debt of US$420,140.72 owed to GetBucks Microfinance Bank Limited.
The judgment, delivered on October 9, 2024, follows a default ruling against Magaya, his company Planet Africa (Private) Limited, and Tendai Magaya. As part of the order, the defendants have been instructed to pay the legal costs incurred by the plaintiff on a higher legal practitioner-client scale.
The property in question spans 3.2323 hectares and includes both the hotel and stadium, located in the Salisbury district under deed of transfer No. 4076/2018. The court has declared the property available for sale to settle the outstanding debt.
Additionally, the court upheld an irrevocable special power of attorney granted to Atherstone & Cook legal practitioners, authorizing them to proceed with the sale and transfer of ownership of the property. The court’s order states:
“The immovable property owned by the first defendant, located in Salisbury district, known as the Remainder of Stand 166 of Prospect, measuring 3.2323 hectares and held under deed of transfer No. 4076/2018, is hereby declared executable.”
The judgment also requires Magaya and the other defendants to jointly and severally pay the owed amount, which will accrue interest at 10% per month starting from September 11, 2024, until fully settled.
This ruling poses significant implications for Magaya’s business operations and public reputation. The leader of the Prophetic Healing and Deliverance Ministry has previously faced numerous allegations, including fraud and rape, and is currently under investigation by the Zimbabwe Gender Commission for allegedly sexually abusing multiple women.
Magaya’s stadium, known as the Heart Stadium, was inaugurated by President Emmerson Mnangagwa in December last year and has been touted as a state-of-the-art facility.
