Builder George Katsimberis, who is charged with fraud, has come under fire from Deputy Prosecutor General Micheal Reza for producing fake evidence against the prosecution.
This statement was given by Reza in response to Katsimberis’s appeal for his third recusal, which was submitted last week.
Reza responded in writing, stating that the defense had submitted a reference-free request for his recusal from prosecuting this case.
I disagree with the application. Their applications are made without reference to any known statutory requirements, as has become customary in this situation. To their credit, they cited Mupungu v. Minister of Justice, a case law that is regrettably completely irrelevant.
The recusal of a judge or a magistrate, he claimed, is covered by the case law mentioned above.
The State further stated that it is common knowledge that a judge’s duties differ from those of a prosecutor.
“Their choices affect a case in court in different ways. For instance, the prosecutor does not determine whether the accused is guilty or innocent. It is neither the magistrate or the judge who will file the charge or withdraw the charge to an accused,” wrote Reza.
According to Mr. Reza, when he wrote the letter dated October 14, 2022, he wasn’t deceiving anyone because the facts speak for themselves and can be verified by reading CRB 241-2/20.
Because the plan in question was a phony plan, the trial magistrate Nduna ESQ determined that Roy could not testify in a case involving the filing of plans, he added.
In all cases where Pokugara Properties, Tatiana Aleshina, or Kenneth Raydon Sharpe have relations to the complainant in this case, they claim, I am always the prosecutor. He claimed the accused and his attorney were really scraping the bottom of the barrel with this claim.
“They mention “four cases running concurrently” in paragraph 5(a) of their application; including this case plus the case of S.V. Tendai Biti to make six cases total. Counsel and his client are acting dramatic, both of them.
They are both aware that I am the lone prosecutor in the current case since the defendant intimidated the other attorneys who handled it. Mr. E Zinyandu and Miss A Chogumaira first prosecuted the case together. The accused falsely implicated the two prosecutors in a lengthy letter of complaint. Despite the fact that they had not broken any laws. They withdrew because they felt uneasy, he claimed.
According to Mr. Reza, Katsimberis often intimidates away prosecutors by either leveling completely unfounded accusations against them, threatening to have them arrested, or actually filing police reports against them.
The following prosecutors have received police reports from the accused: Mr. T. Chirambira, Mr. C. Muchemwa, Mr. R. Chikosha, and Mr. Chesa.
“All of these are attorneys who have either testified in his defense or participated in his prosecution. The following prosecutor, Mrs. T. Makiya, and Ms. C. Mashingaidze, have been pushed aside to work on his case. Miss A. Chogumaira and Mr. Zinyandu. He spoke.
