Businessman Matongo Faces Legal Heat Over US$100K Trust Property Theft

A local businessman Brian Kudakwashe Matongo has been accused of unlawfully disposing of property valued at US$100,000, in violation of a High Court liquidation order.

Kudakwashe Matongo appeared before Harare magistrate Isheanesu Matova but did not enter a plea during the proceedings.

The complainant in the case is Albritim Enterprises, represented by Oscar Tafadzwa Gasva, a legal practitioner appointed as the liquidator for the company.

According to the court, a provisional liquidation order for Albritim Enterprises (Pvt) Ltd was issued by the High Court on October 16, 2019. Subsequently, on December 18, 2019, the High Court finalized the liquidation, officially appointing Gasva as the liquidator.

The company’s declared assets included two Freightliner FLD 120 Horses with registration numbers ADC 1047 and ADC 1048, an International Horse with registration number ADC 7365, a Homemade Trailer with registration ACZ 9845, a Tandem Local Trailer registered as ACZ 9975, and a Trinity Local Semi-Trailer with registration number AEG 1774.

The State alleges that Matongo was fully aware of the court order, which prohibited any business transactions or disposal of the listed assets without the liquidator’s consent. Despite this, he is accused of selling the assets and using the proceeds for personal gain.

The total value of the allegedly misappropriated assets amounts to US$100,000, none of which has been recovered.
