Harare Magistrate Convicts Tendai Biti for Assault

In a verdict delivered yesterday, Harare magistrate Mrs. Vongai Guwuriro found Tendai Biti guilty of assaulting businesswoman and investor, Mrs. Tatiana Aleshina, at the Harare Magistrates Court back in 2020.

The sentencing phase of the trial has been scheduled for today. The trial spanned four years, marked by numerous legal maneuvers and applications filed by Biti and his lawyer, Mr. Alec Muchadehama.

In her ruling, the magistrate emphasized the coherence of witness testimonies, which aligned with the complainant’s account and bolstered the case against Biti.

Mrs. Guwuriro noted that while the exact words spoken by Biti during the altercation may have faded from memory over time, the core incident remained undisputed. She underscored the importance of compliance with existing laws.

Despite attempts by Biti to raise constitutional issues piecemeal, the court remained focused on the evidence at hand, ultimately leading to Biti’s conviction.

Prosecutor Mr. Michael Reza, alongside Mr. Tafara Chirambira, highlighted Biti’s use of disrespectful language toward Mrs. Aleshina, emphasizing that such behavior was unbecoming of a lawyer of Biti’s stature.

Biti’s attempt to portray himself as a defender of justice backfired, revealing underlying personal animosity toward Mrs. Aleshina, stemming from conflicts between his clients and her.

The State argued that Biti’s actions were driven by personal disdain, rather than any noble intentions, tarnishing his reputation as a legal professional. As the case concludes, Biti faces the consequences of his actions, with the court poised to determine an appropriate sentence for the assault on Mrs. Aleshina.
