Court Testimony: The Complainant’s Alleged Vendetta Is Revealed

Kirk West stated in court that he thought James Landon, the complainant, was using the Zimbabwe Anti-Corruption Commission (ZACC) to punish him for disclosing the truth about their previous business dealings.

Kirk West asserted that Landon pursued revenge after West revealed specifics of their car sale, which cost West two cars as a result of ZACC’s purportedly insufficient paperwork.

West also charged Landon with misusing the legal system without a valid reason.

West claims that during their conversations, Nyandoro and Landon both recognised the car’s availability for purchase. Throughout the negotiating process and after the contract was finalised, West emphasised Nyandoro’s integrity.

In his testimony, West described an encounter they had after buying the car, during which Landon promised to reimburse the cash or permit West to keep the car. When Landon later called the police and accused him of stealing without warning, West was taken aback.

West told the court that in the two previous encounters with Landon and Nyandoro after the car purchase, no theft report had been submitted. Admire Rubaya, the lawyer representing Nyandoro, questioned Landon’s motivations for trying to reach an out-of-court settlement so soon before the trial started during cross-examination.

Rubaya also refuted Landon’s claim about where the car was turned over, charging him of tampering with the legal system by accusing Nyandoro of stealing trust property.

According to Landon, Nyandoro was given the Toyota Landcruiser AET 3438 and was required to give it back after a predetermined amount of time. Nyandoro, however, refuted these assertions, saying that there was no official trust arrangement in place, and he claimed to have received the car in exchange for his services during Landon’s argument with Adam Woodington, another businessman, which finally resulted in Landon’s imprisonment.
