A Bitter Dispute: Zimbabwean Sisters Clash Over $120K Varsity Fees

Two Zimbabwean sisters, separated by distance but bound by blood, find themselves entwined in a bitter legal feud over financial support extended by the elder sister to her nephew, the son of her younger sibling.

Berly Nkwazi (72) and Grace Mutasa, despite their familial ties, have found themselves at odds over the $120,000 in fees and living expenses Nkwazi covered for Mutasa’s son, Tawanda, during his studies in Canada.

Tawanda, now employed as an engineer, left Nkwazi’s home in Canada shortly after completing his education, reuniting with his mother and relocating to Australia.

Feeling betrayed and burdened by the loans she acquired for Tawanda’s education, Nkwazi alleges financial hardship, contrasting her situation with the perceived comfort of her sister and nephew abroad.

The dispute has escalated to a legal battle, with Nkwazi pursuing legal action against Tawanda to recover the funds she invested in his education. However, her efforts have faced obstacles, including a jurisdictional challenge raised by Tawanda’s defense team, citing a previous Supreme Court ruling on the matter.

The conflict originated from Nkwazi’s generous gesture to fund Tawanda’s education in Canada, at the request of Mutasa. Despite the lack of a written agreement, Nkwazi took on financial responsibility for Tawanda’s academic expenses.

Tensions arose when Nkwazi discovered financial support provided to Tawanda by his mother and brother without her knowledge, leading to a breakdown in their arrangement.

Nkwazi’s legal pursuit encounters challenges, with Tawanda’s defense referencing a previous Supreme Court ruling and contesting the jurisdiction of the Zimbabwean court due to residency status.

Procedural hurdles, such as failure to provide security of costs and disclose property ownership in Zimbabwe, further complicate Nkwazi’s case.

The prolonged legal battle between the two sisters highlights the complexities of familial relationships, blending legal complexities with moral dilemmas.

As the case unfolds, it serves as a lesson for relatives facing similar situations, emphasizing the importance of clarity, transparency, and legal safeguards in cross-border familial financial arrangements.
